Visiting the website www.rhino-eco-energy.com ("the Site") and using any of the services offered on the Site and on the platform operated or made available by Rhino Eco Inc, DBA Rhino Energy Solutions ("the Company" and "Company services") is subject to these Terms and the Privacy Policy found at www.rhino-eco-energy.com, as updated by the Company from time to time. The Privacy Policy and these Terms are hereinafter jointly called "Terms of Use". This does not affect the provisions of agreements with anyone using the Company site ("User"). Changes in the Terms of Use become effective upon publication on the Company site. The Site and any platform that the Company operates or makes available are referred to jointly as "the Company site". The Terms of Use apply to all visits, attempts to use, and use of the Company site or parts thereof. Entering the Company site, registering for Company services, and using the Company platform constitute consent to the Terms of Use without limitation or reservation. Additional terms may appear on the Company site for specific services; unless otherwise stated, these additional terms are part of the Terms of Use and supplement them without detracting from them. In case of a conflict between these Terms of Use and any individual agreement with a Company customer, the individual agreement prevails. If you do not consent to the Terms of Use, you must refrain from using the Company site. These Terms of Use use the masculine form for convenience only and apply equally to all users regardless of gender identity.
The User declares that they are an adult with legal capacity to perform any actions through the Company site or by other means relating to the Company, including signing these Terms of Use and any agreements. All rights, including intellectual property and moral rights in the Company site, services, content, design, applications, tools, code, and related components ("Company content"), belong to the Company or third parties who have authorized the Company to use them. Company content is protected by Israeli law and international treaties. Users are not granted any rights to Company content except a limited, non-exclusive, non-transferable, personal-use license to access and use the site, services, and content solely for the purposes described on the site and in these Terms of Use, including external interfaces and payment service supplier terms. Company content must not be copied, reproduced, used to create derivatives, transferred, broadcast, published, modified, displayed, or licensed without the Company's written consent. Unauthorized use that breaches law or third-party rights is prohibited. The Company site and content must not be displayed with a design or interface that differs from the Company's specifications without prior written consent and must not be displayed in any way that changes or detracts from the content.
Every user declares, undertakes, and agrees that they have carefully read, understood, and agree to the Terms of Use and that neither they nor anyone acting on their behalf will have any claim against the Company or its agents for lawful use. Users undertake to use the site and services in good faith, according to the Terms of Use and applicable law. Any information supplied to the Company must be accurate and if it changes, users will notify the Company. Submitting incorrect data may harm the user, the Company, and its partners, and may constitute a criminal offense. Users will not breach any laws, these Terms of Use, agreements with the Company, external supplier terms, or payment service supplier terms. Users will not act in a way that betrays the Company's trust, harms the Company, its partners, other users, or the site's proper operation. Users will not be subject to bankruptcy, receivership, liquidation, or similar proceedings during their use of the site. The data displayed on the site does not constitute professional advice, including legal, financial, business, tax, or other advice. Users should consult a professional before making decisions or taking actions based on site contents. Users will not make any commercial use of the site, Company content, or information received in connection with Company or partner services, whether for profit or any unrelated purpose. Users will not store such information or reveal it to third parties. The Company may block access to the site or services at any time if it deems the user has violated these Terms of Use or agreements.
Some users may access a personal zone on the site where certain details about their interactions with the Company and energy system activity are displayed ("Personal Zone"). Personal Zone access requires a One-Time Password or a username and password ("Connection Details"). Users must keep their Connection Details confidential and secure by choosing a complex password and changing it regularly, at least every six months. Users may also connect to an external interface provided by the system manufacturer to obtain data about their system and its activity. The external interface is separate from the Company site and subject to the manufacturer's terms of use. Users must comply with those terms and will not use the external interface in a way that causes the Company to breach the manufacturer's terms.
To receive payments on the site, the Company uses third-party payment services ("Payment Services Provider"). Users declare and accept that their declarations and undertakings apply to their use of the Payment Services Provider's services and that they will not breach the provider's terms or use the payment services in a way that causes the Company to breach those terms.
The information and services offered on the site are provided As Is. Users agree that neither the Company nor its agents shall be liable for any damage incurred from using the Company site. The Company shall not be liable for any damage, loss, or expense incurred directly or indirectly due to events beyond the Company's control. The Company's systems rely on software, hardware, and communications networks that are exposed to data security risks. Although the Company takes measures to protect against such risks, it cannot guarantee absolute prevention of damage and is not liable for resulting harm. The Company is not liable for any disruption or error on the site or in displayed information, whether from the Company or third-party data. The Company shall not be liable for direct, indirect, consequential, or incidental damages arising from access to or use of the site. Neither the Company nor its agents are parties to installation agreements for an energy system or maintenance service agreements for existing systems, nor to agreements with electricity suppliers to which an energy system or the user's home is connected. The Company bears no liability for damages resulting from entering into or breaching such agreements. Users acknowledge that electricity supplier commitments are beyond the Company's control.
If there is a written contract between you and the Company, including a purchase agreement, cancellation provisions in that contract apply. Otherwise, statutory provisions govern transaction and payment cancellations. Users may request payment cancellation by contacting the Company. If the request meets legal and contractual requirements, the Company will process the change according to its policy with the credit company or payment service provider. Users bear any fees charged by the credit company or payment service provider for cancellations, without prejudice to other Company rights.
Rhino may reference, enable access to, or promote third-party services for user convenience. Rhino does not approve, endorse, or recommend any third-party services. Access and use of third-party services are at your own risk and subject to that service's terms of use. Rhino disclaims all liability for use of third-party services linked or embedded in the Site or Platform.
The Parties agree to negotiate in good faith and attempt to resolve disputes within thirty (30) days after written notice. If unresolved, either Party may initiate arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Both Parties waive the right to:
The Company may cease operating the Company site or any part thereof at any time, temporarily or permanently, without notice or user consent. The Company may assign its rights under these Terms of Use to any third party without obligation to publish notice or obtain consent. Users may not transfer, assign, or mortgage their rights under these Terms of Use or any agreement with the Company without prior written consent. If any part of these Terms of Use is invalid or unenforceable, that part will be replaced by valid and enforceable provisions closest to the original intent, and the remaining provisions remain in force.
